Terms of Service
These terms govern your use of Dimarkass. By creating an account you accept them. Effective 2 September 2026.
The service
Dimarkass is an AI assistant for digital marketing. It answers questions from a curated marketing knowledge base, audits your website and analytics, and — for the advertising platforms you connect — prepares campaign changes that you review and approve. It is operated by Nicolás Méndez.
Your account
You need an account to use the service, you must give accurate information, and you are responsible for what happens under your account. Do not share your credentials. Tell us promptly at nicolas.mendez.gonzalez@gmail.com if you suspect unauthorised access. The service is for business use by people aged 18 or over.
Connected platforms are yours
You connect your own Google Ads, Search Console, Google Analytics, Meta Ads and Shopify accounts, and you must have the right to do so. Your use of those platforms remains governed by their own terms, and Dimarkass acts within the permissions you grant. You can revoke access at any time from the Profile page or from the platform itself.
Advertising spend and approvals — read this one
- You approve every change. The assistant never executes an advertising or measurement change on its own. It produces a proposal, you approve it, and only then does it run. Where you deliberately enable autopilot, you are pre-authorising changes within the limits you set, and those changes are still yours.
- You pay the platforms directly. Advertising spend is billed by Google and Meta to your own accounts. Dimarkass never holds your money, never bills you for media, and cannot refund platform spend.
- You are responsible for what you approve. Budgets, targeting, ad copy and creatives that you approve are your advertising. Set the guardrails in your profile to match your risk, and check a proposal before approving it.
- Everything is created paused. New campaigns do not start delivering until you separately approve launching them.
AI output has limits
The assistant is a language model with tools. It can be wrong, out of date, or confidently mistaken. Its advice is not professional, financial or legal advice, and no marketing result is promised or guaranteed. Verify anything material before acting on it, and read the detail on an approval card rather than the summary alone.
Content and generated creatives
You keep ownership of what you upload and of your business data. You grant us only the permission needed to run the service for you — to store your files, retrieve from them, and pass them to the model providers named in the Privacy Policy.
Generated images and ad copy are produced by AI at your request. You are responsible for checking that a creative you approve is accurate about your product, complies with the advertising policies of the platform it runs on, and does not infringe anyone's rights. Only upload product photos and brand material you are entitled to use.
Acceptable use
Do not use Dimarkass to:
- break the law, or the advertising policies of any connected platform;
- advertise on behalf of a business whose accounts you are not authorised to manage;
- produce deceptive claims, impersonate a person or organisation, or create content targeting a private individual;
- attack, overload, reverse engineer or attempt to bypass the safety gates of the service — including the approval gate and the spending guardrails.
Availability
The service is provided as-is and under active development. Features may change, and there is no uptime guarantee. Third-party platforms and model providers can fail or rate-limit independently of us; when they do, parts of the assistant degrade or become unavailable.
Liability
To the extent permitted by law, Dimarkass is not liable for indirect or consequential loss, for lost profit or revenue, or for advertising spend incurred on changes you approved. Nothing in these terms limits liability that cannot lawfully be limited, including for fraud or for death or personal injury caused by negligence. Your statutory rights as a consumer, where they apply, are unaffected.
Ending it
You can stop using the service and delete your account at any time — see Data Deletion. We may suspend or end an account that breaks these terms, or that puts the service or another user at risk. Campaigns already created in your ad accounts remain yours and keep running or staying paused as last set; deleting your Dimarkass account does not pause your live ads, so stop them on the platform if that is what you intend.
Governing law
These terms are governed by Spanish law, and the courts of Spain have jurisdiction, without depriving you of any protection given by the mandatory law of your country of residence.
Changes
We may update these terms. The date at the top changes, and material changes are notified by email before they take effect. Continuing to use the service after that means you accept the new terms.
